These General Conditions of Sale (hereinafter "the GTC") apply to orders placed by any person (hereinafter the "Customer") on the website www.bonange.fr Where www.bonange.com (hereinafter the "Site") of the Sucre d'OR SAS chocolate factory (hereinafter "Sucre d'OR"), a simplified joint stock company with a capital of 12,000 euros, whose registered office is at at 49 rue Lamartine, 78000, Versailles, France, registered with the Paris Trade and Companies Register under number 850 659 319.
The T & Cs apply exclusively to any online order made on the Site. No other specific condition emanating from the Customer can prevail (except express written exemption).
The GTC may be subject to modifications. The GTCs applicable to orders placed on the Site are those in force at the time the order is finalized by the Customer.
Placing an order for products offered for sale on the Site is subject to acceptance of the GTCS.
Questions relating to the characteristics and quality of products sold on the Site, as well as nutritional information concerning them can be addressed to the attention of the Consumer Service:

2) Connection to the Site
To order, the Customer can either create an account on the Site before placing an order, or place an order without creating an account, using the Site as a Visitor.
When the Customer creates an account, he communicates his name, first name, postal address, telephone number and email address and chooses a password. Its data is then recorded by Sucre d'OR. His email address will be his username. He can then access his account using his username and password, place orders and view the history of orders made. The identifiers that the Customer will have defined during his connection will allow him to recall and modify his data at any time.
When the Customer uses the Site as a Visitor, he communicates, when placing each order, his name, first name, postal address, telephone number and email address.
In both cases, the Customer must communicate in an exact and exhaustive manner the data necessary for the processing of his order. The protection and confidentiality of Customer data are ensured by Sucre d'OR in accordance with § 10 of these GTC and its Regulations on respect for private life.
3) Products and availability
The products offered for sale on the Site are presented with their essential characteristics (price including tax, VAT rate, net weight, ingredients) so that the Customer can have as much information as possible before placing his order.
The photographs illustrating the products have no contractual character. The minimal variations in the presentation of the products do not engage the responsibility of Sucre d'OR and do not affect the validity of the sale.
The product offers presented on the Site are valid as long as they are online, within the limits of available stocks.
In the event of unavailability of products, Sucre d'OR will inform the Customer by email or telephone, within two (2) working days of ordering. Sucre d'OR may offer the Customer a product of a quality and price equivalent to the unavailable product. If this solution does not suit the Customer, their order will be canceled and their bank account will not be debited.
The Customer undertakes to complete the order form with precision and to fill in the various sections necessary for placing his order (billing address, delivery address, method of payment, etc.). The Customer agrees to the veracity of the personal information that he has indicated. The Customer can modify the content of his basket and the information entered in the order form at any time, in particular to correct any entry errors, as long as he has not validated his order by clicking on "Place Order". . As soon as the Customer clicks on the "Place Order" button, he undertakes to purchase the products placed in his basket.
As soon as the Customer has finalized his order online, an email summarizing the essential information of the order is sent to him. The Customer's bank account will only be debited after validation of the order by Sucre d'OR.
5) Right of withdrawal
The right of withdrawal is excluded for the purchase of chocolates and Compositions. Indeed, in accordance with article L 121-20-2 3 ° of the Consumer Code, the right of withdrawal cannot be exercised for products which, "because of their nature, cannot be returned or are liable to to deteriorate or expire quickly ", which is the case with chocolate.
6) Prices and terms of payment
On the Site, the prices are indicated in euros, all taxes included and excluding delivery costs (see article 7).
At any time, Sucre d'OR may make updates or changes to the prices applicable to the products. However, the prices are guaranteed as soon as the Customer places the products in his basket. The Customer can only pay by online payment by credit card (Carte Bleue, MasterCard, Visa, American Express) or Paypal.
The data is entered by the Customer on a secure banking platform applying SSL encryption technology, guaranteeing the security and confidentiality of information during entry and during the transaction.
The order is only effective after authorization of the transaction by the bank payment centers then validation of the payment by Sucre d'OR. To be registered, the order must be paid in full. Unpaid orders cannot be delivered.
Sucre d'OR, after confirmation of the order, undertakes to process and deliver the order to the delivery address indicated by the Customer, according to the mode of transport chosen by the Customer. Sucre d'OR insures the goods up to the place of delivery. It is the recipient's responsibility to check the package in the presence of the delivery person. Any anomaly during delivery must be the subject of written reservations indicated on the delivery slip in the presence of the carrier. The Customer has a period of three (3) days (excluding public holidays) from receipt of the products to send the carrier a registered letter in which he describes the damage observed. In the event of a complaint made against the carrier, the Customer must notify Sucre d'OR within three (3) days of receipt of the products.
All packages are packaged by Sucre d'OR in closed packaging adapted to transport requirements.
7.3 delivery address
The products are delivered to the delivery address that the Customer has indicated during the ordering process. This may be the Customer's address or the address of a third party, for example for the delivery of a gift order. In this case, the Customer provides his own contact details for the billing address. The Customer agrees to the veracity of the data that he will have indicated when ordering. In the event of an error in the wording of the recipient's contact details, Sucre d'OR cannot be held responsible for the impossibility of delivery to the recipient. The re-routing of the package to another recipient or to a new delivery address will be invoiced to the Customer.
7.4 Possible delivery locations
Deliveries are made exclusively in mainland France and Corsica.
7.5 Delivery times
The delivery time applicable for shipments to mainland France and Corsica depends on the delivery method chosen by the Customer, which can be either "Standard" or "Express".
In order to guarantee Customers optimal product quality, during the summer and during periods of high temperature (> 22 ° C), the shipment of orders may be postponed and is carried out when temperatures have dropped. The customer is explicitly informed of this postponement of shipment before confirming his order. In the case of high temperatures, Sucre d'OR reserves the right to postpone or cancel a shipment, with the Customer's agreement, in particular in the event of a heat wave.
In such cases, the Customer will be informed during the ordering procedure or by email.
Standard delivery time is 3 to 5 working days (Monday to Saturday) from order placement, excluding periods of high temperatures.
Notwithstanding the foregoing, for orders over 25 kg which require more preparation time, Sucre d'OR strives to deliver the products as soon as possible. In this case, the maximum delivery time is thirty (30) days.
Due to the end of the year holidays, delivery times for orders may exceptionally be extended.
7.6 Delivery costs
The delivery costs associated with the order are calculated according to the average total weight of the package (s) and the delivery method (Standard or Express.) The delivery costs are indicated in the Delivery costs section and are reminded to the Customer at the time ordering when choosing the mode of transport.
7.7 Delay in delivery

The Customer may also request the cancellation of his order if the delivery has not taken place no later than seven (7) days after the delivery date indicated by Sucre d'OR, unless this delay in delivery is due to a case force majeure. Sucre d'OR will then reimburse the price of the product ordered within thirty (30) days of its request.
Sucre d'OR cannot be held responsible for a delay due to a case of force majeure, an error or omission in the delivery address indicated by the Customer.
7.8 Absence of the recipient during delivery
In the absence of the recipient or of a person who can take possession of the products upon delivery, the carrier will leave a calling card at the delivery address indicated by the Customer. This notice will indicate a representation the next day or will invite them to come and collect their products within fifteen (15) days at a specific collection point. Under no circumstances can Sucre d'OR be held responsible for a delay in delivery or any deterioration of the products due to their late withdrawal from the carrier.
The optimal use-by date (DLUO) for Sucre d'OR chocolates is indicated on each product containing chocolate. The remaining average shelf life of the products delivered is ten (10) to twelve (12) months. Sucre d'OR guarantees the quality and freshness of its products, provided they are stored in a cool place (between 14 and 18 ° C), protected from light. Sucre d'OR invites the Customer to check the goods delivered upon receipt and to compare them with his order. Any complaint must be made within a maximum of 3 days after receipt, to the Consumer Service, by registered letter with acknowledgment of receipt to: Sucre d'OR SAS, 49 rue Lamartine, 78000 Versailles, France. This complaint must include as much evidence as possible to demonstrate the damage suffered. In the event of a defective product or a non-compliant order, the Customer is entitled to demand that it be replaced by Sucre d'OR. If the replacement of the product ordered by an identical product is impossible, or cannot be implemented by Sucre d'OR within one (1) month following the Customer's complaint, the Customer may either return the defective product or the non-compliant order and obtain a refund (shipping costs included); or benefit from a price reduction after analysis and acceptance of its complaint by Sucre d'OR.
In the event of a return, the item must be returned to Sucre d'OR within 14 days of receiving it. The Customer must send it in its original packaging or in another packaging guaranteeing transport safety, enclosing a copy of the invoice, to the following address:

If the Customer opts for the reduction of the purchase price, he will keep the product and Sucre d'OR will reimburse him for the amount of the agreed reduction, by crediting the card used during the online payment of the order (secure transaction), within seven (7) days.
9) Retention of title
The delivered goods remain the property of Sucre d'OR until full payment of the purchase price. The transfer of risks to the Customer takes place upon delivery of his order.
10) Use of stored data / Data protection
Sucre d'OR applies the provisions of Law n ° 78-17 of 6 January 1978 relating to data processing, files and freedoms. Information relating to the nature, extent and purpose of the collection and recording, by Sucre d'OR, of the personal data necessary for the execution of the purchase contract is set out in our Regulations. on respect for private life.
11) Limitation of liability
Sucre d'OR cannot be held liable in the event of non-performance or poor performance due to a case of force majeure as defined by the case law of French courts. Likewise, Sucre d'OR cannot be held liable in the event of damage resulting from the use by the Customer of the Internet network.
For customers suffering from food allergies or diabetes, it is advisable to consult the nutritional information and lists of ingredients indicated on the packaging as well as on the product description page on the Site.
